AYIA NAPA - Five of the 12 Israelis suspects in the gang rape of a 19-year-old British tourist in Cyprus were questioned by police Saturday in the capital of Nicosia, including the main suspect.

According to the five suspects' lawyer, three of them are maintaning their right to silence. Another one "has cooperated and will apparently be released in the coming days," the attorney said.

According to a report released by the Famagusta police, only three of the suspects denied during their interrogation that they were present at the scene during the assault.

The report states that the complainant and the main suspect had met a few days before, and that they had already had sexual relations. On Wednesday night, she went to his hotel room in the Ayia Napa resort where they were staying. During intercourse, the suspect became violent, and when the complainant asked him to stop, he did not, and instead continued by force.


The suspect then called in his friends, and about 12 people entered the room and watched. Some joined in the assault, and a few filmed it on their phones.

The complainant managed to escape the room, still naked, and run away. Though some of the suspects followed her, she was able to find two of her friends and explain what she had endured. They took her to a private clinic within the hotel and called the authorities.

"She was in tears and just so distressed," a friend of the woman told the British Daily Mail website. "She told me straight away that she had agreed to have sex with one of the Israeli men and then the others all ran into the room." She notes that the woman was "covered with bruises."

The suspects, all Israeli nationals aged 16 to 19, were arrested on Thursday afternoon, and their cellphones were taken as evidence. Saliva samples were taken from the suspects and sent for analysis, to be compared to DNA samples found at the scene and during the complainant's medical examination.

During his initial interrogation, the main suspect denied all connections to the complainant, but later went on to admit that they had had sexual relations twice before the incident. According to his version of events, he and another friend had consensual sex with the complainant that night, and no one else was in the room.

He changed his story again later on, saying that a few friends entered the room, but only watched. Police who investigated the hotel room after the incident found five used condoms and 13 torn condom rappers. A medical examiner found fresh abrasions on the woman's lower limbs.

The court decided on Thursday to extend the suspects' remand by eight days. Police have emphasized that the investigation is still in its early stages, and estimated that they will collected the testimony of 35 people, among them those of friends of the suspects, hotel employees and eyewitnesses. The complainant will identify the suspects, and CCTV footage will be inspected.

All but one of the suspects are from three different groups of tourists, one from Jerusalem, one from Afula and one from Haifa's Krayot suburbs. In addition to the investigation in Nicosia, police will continue questioning the remaining suspects in other cities in Cyprus. Three are being held in Limassol, two in Larnaca and two in Ayia Napa, where the alleged assault took place. The suspects are represented by several groups of attorneys, who have been replaced a few times.

A 19-year-old British teen who was allegedly gang raped by 12 Israelis at a resort town in Cyprus has claimed she was forced to retract her accusation under pressure from local police.

Last month, 12 Israelis aged 15 to 18 were arrested on suspicion of raping a British teen in their hotel room in the popular tourist resort of Aya Napa, Cyprus. However, little over a week later all 12 teenagers were released and allowed to return to Israel after the British woman admitted to having fabricated her accusations against them.

The teen confessed that she had engaged in consensual sex with several of the Israelis but was filmed by them in the process, making her feel “angry and insulted” enough to file the rape accusation. She was subsequently arrested and could face up to a year in prison for misleading local authorities.

However, the unnamed British teen has now claimed that she was forced to retract her initial accusation against the Israelis under duress, arguing she was denied access to a lawyer and that Cypriot police threatened to arrest her friends if she did not recant her testimony.

According to an exclusive yesterday by British newspaper the Sun, the teen “says she was denied a lawyer and then pressurised to withdraw her complaint by [Cypriot] detectives, who threatened to arrest her friends for ‘conspiracy’ if she did not comply”.

“The teenager claims officers then dictated a statement in which she admitted faking allegations,” the British daily added, “and she reluctantly signed only because she was exhausted after eight hours at the police station.”

The British teen’s lawyer, Michael Polak, argued that “[the girl’s] confession was obtained under oppression given the threats made. She was not cautioned and was not given access to a lawyer as was her right under the European Convention on Human Rights.”

“It is also understood that unfortunately none of the proceedings at the Cypriot police station were recorded,” Polak added.

The Sun also claims to have seen police reports of the incident, including medical examinations of two Israelis which found “suspicious scratches” and “bruises on their backs and chests, as if they had been in a struggle”.

The newspaper added that the Israeli teens then “told detectives they had been attacked at the hotel by the girl’s friends,” but added that “the hotel’s manager insisted no such fight took place”.

The girl’s allegations add yet another element to an incident fraught with discrepancies and conflicting narratives, which has raised questions about the Cypriot authorities’ handling of the case and the early release of the Israeli teens.

Last week, seven of the accused teens returned to Israel, being greeted by fanfare and celebration at the country’s Ben Gurion Airport. As Israeli daily the Times of Israel reported at the time, the “teens were jubilant when they were greeted by their cheering families” and “loudly celebrated their release by opening champagne bottles, chanting ‘Am Yisrael Chai’ [the people of Israel live] along with ‘the Brit is a whore’.”

The teens did not express any regret about the incident, with one telling Hebrew-language media: “I feel great. The truth came out and I am happy.” Another teen called his release “a miracle from God” and vowed to sue the British teen for libel.

Meanwhile Israeli journalists, social media activists and onlookers criticised the boys’ “hero’s welcome”, pointing out that had the alleged incident taken place in Israel, the teens would have faced criminal charges for filming the sex act, which was made illegal in Israel in 2014.

It is not yet clear whether there is now any recourse to re-investigate the Israelis should the British teen’s accusations against the Cypriot police be proven. She currently remains in custody and is slated to appear in court on Wednesday, though could wait several months until being brought to trial.

The British teenager faces jail time of up to a year for falsely accusing 12 men of rape

The parents of a 19-year-old British woman who is charged with making a false gang-rape claim in Cyprus have launched a crowdfunding bid to pay her £15,000 legal fees.

Her family set up the Gofundme page on Wednesday to raise money for her legal team to fight the public nuisance charge which could see her jailed for a year.

The 19-year-old had alleged she was raped at a hotel in the popular resort town of Ayia Napa, where she and a group of Israelis, aged between 15 and 18, were staying.

She will remain in police custody at a detention centre in Nicosia until her next court appearance on August 19.

In an emotional plea on their fundraising page, her parents wrote: “In the early hours of Sunday the 28th of July 2019, following a week of traumatic events, our daughter was arrested for allegedly making a false allegation of rape in Cyprus and is currently being detained in prison awaiting trial.

“We maintain that the statement was given under duress and in breach of her rights, resulting in the collapse of the initial investigation and charges of public mischief being made against her.

“She is alone in a prison abroad after an awful series of events, we just want to bring her home.”

They go on to explain that they are “seeking funds to pay for the required legal representation in Cyprus” with the help of an organisation called Justice Abroad.

“They are bringing together an expert legal team, from both the UK and Cyprus, to challenge the many breaches of her rights and require funds to do so,” the statement reads.

A British lawyer will be tasked with allocating the funds raised to “appropriate costs” in the 19-year-old’s defence.

“The crowdfund is being carried out in this way to protect the anonymity of our daughter who we believe to be the victim in this case,” the Gofundme page states.

“Any assistance possible to achieve justice would be gratefully received and any excess funds will be allocated to related women’s rights and legal charities at the end of the case.”

The parents’ plea comes as their daughter seeks a new lawyer, after her previous one dramatically quit on Wednesday.

Andreas Pittadjis withdrew from the case citing a “serious disagreement” with his client.

"There is a serious disagreement with the defendant on how to handle the case, so I ask for the court's permission to withdraw," he told a court in court in Paralimni.

Mr Pittadjis later told reporters his resignation should not be connected to how the woman would plead.

It came after Justice Abroad claimed detectives had pressured her into retracting her rape allegations.

A British teenager has been found guilty of lying about being gang-raped by a group of 12 Israeli tourists six months ago in Cyprus. The 19-year-old, who cannot be named for legal reasons, was arrested after police said she withdrew an accusation that the Israeli teenagers raped her in a hotel room at the holiday resort of Aya Napa in mid-July. Her passport was retained, and she has not been allowed to leave the island.

In court, the woman insisted that she was raped but had been pressured into changing her account of what happened by Cypriot police, Reuters reported. The police denied this.

According to the BBC, the judge at the Famagusta District Court charged her of causing public mischief. She could face up to a year in jail and a £1,500 fine, but her lawyers have asked for a suspended sentence.

In his ruling, Judge Michalis Papathanasiou said that the teenager did not tell the truth and tried to deceive the court with “convenient” and “evasive” statements. Her sentencing is scheduled for 7 January.

The young woman filed a complaint to Cypriot authorities in which she claimed to have attended a party with one of the suspects, later agreeing to go to his hotel room. She claimed that, once inside, 11 other teens entered the room and proceeded to rape her, holding her down and filming the assault while she screamed.

The Israelis – all aged 15 to 18 – were arrested in July on suspicion of raping the unnamed British teen in the popular tourist resort, but were released and had the charges against them dropped by the Cypriot authorities after they claimed that the filming and “everything was consensual”.

Prosecutors told the court that the defendant had fabricated the gang-rape allegations as she was angry at having been filmed while having sex. None of the youths were called to give evidence. Indeed, the Israelis were allowed to return to Tel Aviv, where they celebrated their release, shouting “the Brit is a whore” and popping champagne at Ben Gurion Airport.

Michael Polak, a lawyer from the Justice Abroad group, which is assisting the woman, criticised the handling of the case by Judge Papathanasiou, who, he said, refused to hear any evidence about whether the alleged rape took place.

The teenager’s defence lawyer, Nicoletta Charalambidou, told reporters outside the court that they plan to appeal against the verdict. “The decision of the court is respected,” she said. “However, we respectfully disagree with it. We believe that there have been many violations of the procedure and the rights of a fair trial of our client have been violated. We are planning to appeal against the decision to the Supreme Court, and if justice fails […] we are planning to take our case to the European Court of Human Rights.”

Soon after police arrived at the Pambos Napa Rocks Hotel in July, rounding up the suspects who would later be cleared, parents some 250 miles away grew increasingly concerned.

But some of the suspects have family friends in powerful positions. One of their fathers is an adviser to the mayor of Jerusalem, while an Israeli government minister has admitted being a close friend of the parents of two of the suspects. Nikos Dendias met political leaders in Jerusalem and told reporters at a press conference: ‘I must say that the briefing here on everything that is happening in Cyprus is very important to us.’

The two countries share enormous economic interests, with a joint gas project on the Mediterranean island, and have many strategic ties too. Their alliance is seen as significant at a time of growing Turkish belligerence.

At the time of the arrests, the Israeli media followed the case closely.

Five of the boys were released a week after the incident, with Cypriot police saying there was no evidence they had been present. The other seven were released three days after that, on July 28, when the teenager retracted her allegation.

Their homecoming was heralded by champagne corks popping at Ben Gurion airport and chants of ‘the Brit is a whore’.

Two days later, the Mako news site in Israel revealed that the father of one of the boys was a senior adviser to the mayor of Jerusalem.

The father flew to Cyprus and was quoted as saying that what had happened in the room was ‘a morally wrong thing for the boys – someone had to stop it’. However, he maintained that his son was innocent.

Meanwhile the Israeli minister for regional cooperation, Tzachi Hanegbi, said in an interview he was a close friend of the parents of two of the suspects and was ‘under the impression that most of the boys have been seriously wronged’. The 12 all received legal assistance from the Israeli consul in Cyprus, although this is not out of the ordinary.

There is no evidence that the Israeli government, which has close ties with the government in Nicosia, exerted more pressure than usual in a case in which Israeli citizens were arrested abroad.

Although a local paper described investigators as ‘Keystone Kops’, Cypriot officials backed the police decision to release the Israelis. Outside court, before the trial of the British woman had even begun, the then mayor of Ayia Napa, Yiannis Karoussos, had assumed her guilt, threatening to sue her for defamation.
